Famous Foreign Trademarks in Armenia

• Usage Requirement: To receive protection as a famous foreign trademark in Armenia, the trademark must have been used domestically within the country. Protection is extended only when the foreign trademark has gained significant recognition among the relevant Armenian public through actual use.

• Listing of Well-Known Trademarks: Armenian law stipulates that the Armenian Intellectual Property Agency (AIPA) must maintain a separate list of well-known trademarks. To have a trademark listed as well-known, an applicant must submit a request to the AIPA Appellate Committee. This request should include evidence demonstrating the level of recognition and must be accompanied by the payment of a state fee, which is approximately USD 600. Once submitted, the Appellate Committee has a two-month timeframe to affirm the well-known status of the trademark. Such affirmation grants the foreign trademark protection equivalent to that of registered trademarks. The list of well-known trademarks is available online at AIPA's website.

• Protection Against Registration: Even if a foreign trademark is not in use and is not well-known in Armenia, it may still be protected in cases where it can prevent the registration of an identical or similar trademark in Armenia. This occurs when there is a likelihood of confusion, and the trademark applicant was aware or could have been aware of the existence of the foreign trademark.

• Unfair Competition Protection: Notably, a sign used domestically without any formal registration may still receive protection under Armenian unfair competition law. This provides a level of safeguard for unregistered marks within the country.
