Appeals in Trademark Litigation in Armenia

In trademark litigation in Armenia, there is a specific process for appealing court decisions. Here is an overview of the appeals process in trademark litigation:

1. Appeal to the Court of Appeals: After a judgment is issued by the court of general jurisdiction in a trademark litigation case, parties have the right to appeal the decision to the Court of Appeals. The appeal must be filed within one month from the day of publication of the judgment. The appeal is subject to an amount in dispute of a minimum of $120.

2. Grounds for Appeal: Parties can file an appeal on various grounds, including violations of civil procedure provisions, mistakes in the finding of facts, incomplete finding of facts, or incorrect application of material law. The Court of Appeals reviews the case within the limits of the appeal.

3. Review by the Court of Appeals: The Court of Appeals reviews the case based on the grounds presented in the appeal. New evidence is generally not admissible during this stage of the appeals process.

4. Appeal to the Court of Cassation: If a party is dissatisfied with the decision of the Court of Appeals, they can further appeal to the Court of Cassation. The Court of Cassation's role is primarily to decide on matters of law, its interpretation, and its application. It does not review the facts of the case.

5. Final Decision: The decision of the Court of Cassation is typically the final decision in the appeals process. Once the Court of Cassation issues its decision, the appeals process is concluded.
