Duration and Maintenance of Trademark Registrations in Armenia
Initial Registration Period: A trademark registered in Armenia is valid for a period of 10 years, starting from the date of filing the application.
Renewal: Trademark registrations can be renewed for additional 10-year periods. To maintain the registration's validity, the trademark owner must pay official renewal fees, which are currently around $300 for a trademark in one class. This renewal can be done before the expiration of the 10-year term or within a six-month grace period (for a higher fee).
Proof of Use for Renewal: No proof of use is required at the time of renewal to maintain the trademark. However, it's important to note that if the trademark has not been effectively used within five years after the date of registration, it may be subject to cancellation due to non-use, regardless of whether the official renewal fees have been paid.
Burden of Proof: In the event of a dispute regarding the use of the trademark, the burden of proving its use falls on the trademark owner. This proof can be provided through various means, including sales invoices, advertisements, and license agreements.
