Assignment Documentation for Armenian Trademarks

  • Registration with AIPA: Assignments of trademark rights in Armenia must be officially registered with the Armenian Intellectual Property Agency (AIPA) to be legally recognized.

  • Written Assignment Document: The assignment must be documented in writing. The written assignment document should clearly outline the details of the transfer of trademark rights.

  • Assignor's Signature: The assignment document must bear the signature of the assignor, who is the previous owner of the trademark rights. This signature is essential for the validity of the assignment.

  • No Notarization or Legalization: Unlike some countries, Armenian law does not require notarization or legalization of the assignment document. The written document signed by the assignor is typically sufficient.

  • Party Details: The assignment document should clearly identify the parties involved, including their names and full addresses. This ensures clarity about the identities of the assignor and assignee.

  • Trademark Specification: The document should specify which trademarks, including both registrations and applications, are being transferred from the assignor to the assignee.

  • Translation into Armenian: To comply with local regulations, the assignment document should be translated into Armenian.

  • Power of Attorney for Agents: If the assignment process is handled by an agent or representative on behalf of the new owner (assignee), the agent may require a power of attorney from the assignee. This power of attorney does not typically need notarization or legalization.

  • State Fee: A state fee, approximately $150, is typically payable for registering the assignment with the AIPA.
