Trademark Marking in Armenia
Registered Trademark Symbol: Trademark owners in Armenia have the option to use the ® symbol to indicate that their trademark has been officially registered with the Armenian Intellectual Property Agency (AIPA). They can also use the phrase "registered mark" as per Article 12 of the Armenian Law on Trademarks. The use of these symbols serves as a notification that the trademark is registered and, therefore, legally protected. This can act as a deterrent to potential infringers and informs third parties of the trademark's protected status.
Voluntary Usage: It's important to note that the use of these symbols is not mandatory. Trademark owners have the choice of whether to use them or not. Importantly, the ability to seek damages in cases of trademark infringement is not contingent on the use of these symbols.
False Indications and Unfair Competition: Misleading or false indications related to trademarks are considered unfair competition practices and may be subject to legal sanctions under the Law on Protection of Economic Competition.
