Validity of Trademark Assignment in Armenia

  • Written Assignment Requirement: In Armenia, the assignment of trademark rights must be executed in writing to be considered valid. This means that a formal, written document is essential to legally transfer trademark rights.

  • Registration with AIPA: In addition to the written document, the assignment must also be officially registered with the Armenian Intellectual Property Agency (AIPA) to be recognized as valid.

  • Failure to Register: Failure to register the assignment with the AIPA can render the assignment unenforceable not only against third parties but also against both the assignor (previous owner) and the assignee (new owner). This emphasizes the importance of proper registration.

  • Examination and Registration Period: The AIPA typically has one month to examine the submitted documentation and complete the registration process for the assignment.

  • Appeal Rights: If the AIPA refuses to register the assignment, an appeal can be made. This appeal can be directed to either the court or the AIPA Appellate Committee.
